EdSource: California bill limiting immigration enforcement in schools advances in state Senate

A California bill to limit immigration enforcement in schools advanced in the state Senate Wednesday.

Senate Bill 48, introduced by Sen. Lena Gonzalez (D-Long Beach), would require schools and county offices of education to deny permission to immigration enforcement officers to enter a campus or question a student unless they have a judicial warrant or court order. In addition, the bill would prohibit schools from sharing information about students, staff or families with immigration officials, unless they have a judicial warrant.

“Immigration actions near schools have a chilling effect on student attendance, create learning loss and affect students’ mental health,” said Gonzalez.

Current state law already prohibits school personnel from collecting information about students’ or families’ immigration status or citizenship status. The state attorney general has previously directed schools to ask for judicial warrants from immigration officers, but there was no law requiring it.
